CORONADO YACHT CLUB

SLIP REGULATIONS  

AUTHORITY OF THE PORT CAPTAIN

 

The Port Captain or his delegate shall advise any Member, in writing, of any infraction of the following rules, regulations or guidelines.  Discrepancies must be corrected within a reasonable amount of time unless they involve safety, when they shall be corrected immediately.  Discrepancies not corrected in compliance by the Member will be corrected by the Club, and the Member will be charged for the work involved.

 

EVIDENCE OF OWNERSHIP OF YACHTS

 

It is the intended purpose of these regulations to permit equitable progression on the waiting list of those members awaiting wet or dry slip assignments and to preclude members from entering into simulated joint ownership agreements for the purpose of circumventing this equitable progression.

 

a.    As a prerequisite and condition to the occupancy of a wet or dry slip and the use thereof (other than uses covered in paragraph 1 of the Slip Rules and Regulations), a Member shall file with the Club office a copy of current registration, documentation or charter, and an insurance policy for a minimum of $300,000 naming Coronado Yacht Club as an additional insured.  The Club Manager shall maintain a file of all yachts berthed in a wet or dry slip at the Club with required evidence of ownership.  Club Members must provide evidence of current registration or documentation, on or before their renewal date. Upon 30 days written notice from the Club office concerning proof of ownership, slip fees will be doubled until such proof is provided.

 

b.   A Member whose yacht has been assigned a wet or dry slip must, as a condition for the continued use thereof, notify the Port Captain in writing of any change in ownership or charter arrangements of said yacht and file with the Club office a copy of the new ownership or charter agreement, which must specifically state the names of the owners and/or charterers and the percentage of ownership of each respective owner or charterer.  Attached to said copy of the ownership or charter agreement shall be a sworn statement by the Member certifying that the document is a true, current and complete copy of the original ownership or charter agreement.  No oral agreement or understanding shall satisfy the terms and provisions of this paragraph.  A Member who has been assigned a wet or dry slip who becomes less than a 50% owner or charterer of the yacht occupying said assigned slip shall forfeit his or her slip, shall vacate the same and his or her slip agreement shall be deemed canceled and of no further force or effect. 

 

c.   For jointly owned or jointly chartered yachts, the following will be strictly enforced:

 

1)            Except for the courtesy and transient berthing described in paragraph 1 of the Slip Rules and Regulations, no boat will be berthed on Club property unless all owners or charterers of the boat are members of the Club and one owner must be eligible for the slip assignment.

 

2)            No wet or dry slips shall be assigned to or occupied by a Member who owns less than a 50% share in the ownership of the yacht for which the slip is being sought or has been assigned.  A Member keeping his or her yacht in a wet or dry slip assigned to him or her must be the owner of at least a 50% share of said yacht and a Member who is a charterer must likewise have an interest in said charter of at least 50% of the interests therein.

 

3)            The owners of jointly owned or jointly chartered yachts (except those yachts owned or chartered jointly by a Member and his or her spouse/registered domestic partner) shall furnish the Club office with a copy of their joint ownership or joint charter agreements as a condition precedent to the yacht's occupying either a wet or dry slip.  These joint agreements must specifically state the percentage of ownership or charter participation of the respective owners or charterers and shall have attached thereto a sworn statement by the majority owner or charterer certifying that it is a true and complete copy of the original instrument.  No oral agreement or understanding shall satisfy the terms and provisions of this paragraph. 

 

4)       Procedures for Joint Ownership Approval &

Annual Renewals Procedure: 

1.             Application is made to Boat Survey Committee

 

a.       Boat Survey Committee/Joint Ownership Chair will review applications and interview applicants to determine compliance with spirit and intent of regulations. completed paperwork, etc. Recommendations will be made to Port Captain to "approve," "approve with conditions" or "disapprove. "

 

b. Boat Survey Committee/Joint Ownership Chair will   provide written rationale for recommendations.

 

2.             Port Captain would make recommendation to BOD.

 

3.             BOD would review the application and recommendations and any clarifying information and take one of the above  recommended actions.

 

4.             Action of the BOD would be final, with no appeal.

 

5.             All joint ownerships must be renewed annually (at the beginning of the "Club" year), regardless of date of inception/approval or length of time partnership has been in existence.

 

 

Requirements:

 

1.             All owners or charterers of the boat are members of the Club and one must be eligible for the slip assignment.

 

2.             The member with the slip assignment must be the owner of at least 50% of the boat and have at least 50% interest in the charter.

 

3.             Owners must file a joint ownership agreement as specified in the yearbook, which include the following:

                                i.              The % of ownership

ii.                    The intention that all owners will use the

                boat

iii.            The intention that all owners will be actively engaged in   yachting

iv.            That all owners will participate in getting the boat "under-way."

v.             That eligibility for a slip at CYC cannot be an element of the joint ownership agreement

vi.                  That maintaining membership in CYC cannot be an element of the joint ownership agreement

 

4.             Documents submitted to the office each year must include the names of all joint owners (i.e. insurance, registration & title).

 

5.             Documents must be submitted to the Boat Survey Committee each year certifying that the joint ownership remains in place, signed by all owners, signifying their intent to comply with all regulations for the coming year.

 

6.             Each owner will be expected to participate in the demonstration of the compliance with the "underway" rule and may be required to verify this compliance to a member of the BS Committee.

 

7.             If it is determined that the original owner eligible for the slip assignment is one of the following: no longer a valid member of the joint ownership; or no longer a member of the club, the remaining members of the joint ownership will be notified in writing that the slip must be vacated within 30 days.

 

8.             It shall be prima facie evidence of conduct injurious to the Club for a Member who has been assigned a wet or dry slip, to utilize such slip contrary to the provisions and intent of these Slip Regulations or contrary to the terms of any Slip Rental Agreement entered into.  Such conduct may be cause for loss of membership.

 

SLIP RULES AND REGULATIONS

 

1.             Courtesy berthing may be granted to yachts belonging to members of recognized yacht clubs and guests of the Coronado Yacht Club holding guest cards when dock space is available. Visiting yachts that wish to occupy a slip must first show proof of insurance on the yacht.   Such free courtesy berthing will normally be for a period of three days per visit for a total of no more than nine days per calendar year.   After three days, rates listed in paragraph 33.a. shall apply.  Berthing for these guest yachts will normally be limited to ten days per visit and a total of twenty days in any calendar year.  Members of the Coronado Yacht Club in absent status who bring boats into the Club shall be considered as members of another recognized yacht club regarding berthing privileges and slip rental fees. The Board of Directors may make specific exceptions to this general policy as needed to conform to reciprocal privileges established with other yacht clubs.

 

2.             The front float known as the "turning basin/guest dock", shall be for the temporary berthing of visiting yachts and for the embarking and disembarking of passengers.  During scheduled regattas and other scheduled events the Port Captain may allow those boats directly involved with the event to tie up at the turning basin/guest dock.

 

3.             The use of the Dinghy Dock is limited to vessels less than 14 feet LOA and the length of continuous stay is limited to less than 24 hours.

 

4.             Only approved dock boxes may be used in dry slips for boat equipment storage.  Contact the office staff for a list of approved equipment. The following shall be the Board of Directors policy of the Coronado Yacht Club concerning dock boxes in use upon the wet slips on the CYC property.

 

  1. Effective December 1, 2004, only solid fiberglass dock boxes capable of containing any fluid, or powder spill, shall be approved for use at CYC. Damaged or deteriorated fiberglass; wood, plastic, or fiberglass/wood combination boxes are not approved for use upon CYC docks and shall be removed by the member, within one (1) month upon notification from the Board of Directors or the Club Manager. If the box is not removed in a timely manner the Board of Directors shall have the non-compliant dock box removed from CYC property. Members wishing to petition the Board requesting to keep an existing dock box may do so provided it is fully fiberglassed inside and meets the aesthetic and containment requirements. The petitioning member shall obtain written consent from the Port Captain or Boat Survey Chairman attesting that the dock box meets the CYC requirements.
  2. Approved dock boxes may be fastened to the dock, however a proper bedding compound shall be used and the installation must be inspected and approved by the Facilities Director, Port Captain, or Boat Survey Chairman.
  3. Members bringing a new dock box onto a wet slip at CYC after December 1, 2004, shall chose from one of two approved designs from Innovation Fiberglass Products, Inc. (Part # C-1 and Part # C-4).  Members may petition the Board of Directors for a variation to the approved design if said variation meets all other requirements.
  4. Each slip shall be limited to one (1) approved fiberglass dock box placed as directed by the Director of Facilities.  Members wishing to add an additional approved dock box may petition the Board of Directors. Petitioning member shall obtain written notification by the Port Captain or Boat Survey Chairman attesting to space being available without infringing upon safety requirements or neighboring boats.

 

5.     The Board of Directors may limit the use of a slip if it determines that such action is required by safety concerns or other issues injurious to the Club.

 

 

6.     A Member who removes their yacht from the Club premises for a period of more than 24 hours shall notify the Club office in writing by completing the Float Plan for that purpose. The Port Captain shall notify a member in writing if a Float Plan has not been filed. Subsequent omission will be referred to the Board of Directors for their action. Any wet or dry slip temporarily vacant may be reassigned by the Port Captain for the duration of the vacancy.  A member who is not assigned a slip and brings a yacht onto the premises shall contact the office or security, if after office hours, as soon as possible.

 

7.      Subleasing of a wet or dry slip is prohibited.

 

8.     Boat baths and Hydro-Hoist apparatuses are not permitted within the CYC leasehold.  Any Hydro-Hoists in use at CYC on or before May 14, 2010 may stay “as is and where is” as long as that apparatus is in proper working order and is maintained in conformance with CYC Yacht Standards.  In the event the present slip alignment is significantly altered, any existing Hydro-Hoists will be moved to a conforming slip.

 

9.     Boats assigned to a wet or dry slip will not be moved to any other without the approval of the Port Captain.  Requests to change wet or dry slips must be to the Port Captain, in writing and delivered to the Club office. The request will be entered onto the Better Slip List. The Port Captain will consider such requests according to the dates of application.  Trades of slips between members are prohibited. However, the Port Captain may seek voluntary exchanges of slips for special circumstances subject to the approval of the Board of Directors.

 

10. When a Member severs his or her connection with the Club for any reason he or she shall immediately remove their boat from Club property.  Following the death of a Member who leaves no spouse/registered domestic partner or whose surviving spouse does not remain an active Member of the Club, whoever has control of the decedent's boat shall remove it from the club within thirty days of the Member's death.  If a surviving spouse/registered domestic partner retains Club membership and is or becomes owner of the decedent's boat, no change in slip assignment will be made.

 

11. Rafting of boats to other boats attached to CYC slips is prohibited except on race or regatta days or during special events and only with the approval of the Port Captain.

 

12. A multi-hulled boat may only be berthed in a space that will not accommodate more than one boat.

 

13. Waterborne boat lifts (e.g. Hydro-Hoists) are subject to the inspection and recommendation of the Port Captain, and to the discretionary approval of the Board of Directors.  Upon receiving approval from the Board of Directors and prior to placing any boat lift equipment on Club property, the Member shall read, agree to and sign the required addendum to the Coronado Yacht Club Wet/Dry Slip Rental Agreement. 

 

 

14. Use of the Club hoist is restricted to Members and Club employees only.  The hoist shall be locked and the key maintained in the Club office.  Club Members may obtain a key by first being "checked out" on the operating procedures by the Club Manager.  The Manager shall maintain a list of the members who are qualified to use the hoists.  Unqualified persons who use and damage the hoists will be personally responsible for the costs of repairs.

 

15. Club owned boats shall be operated by Club employees or designated Race Committee personnel on Club business only.  Members may use Club owned boats as long as it does not interfere with the Club employees’ use of the boats, or require the assistance of the staff.

 

16. Slips and docks shall be clear of gear at all times to permit free access to the extreme ends of the docks.  Nothing shall be placed on the walkways or docks, which would prevent free access by emergency equipment and personnel.  Other than equipment provided by the Coronado Yacht Club, only approved dock steps or dock boxes shall be kept or stored on the docks or walkways without prior approval of the Club Manager or the Board of Directors.  Contact the office staff for a list of approved equipment.

 

17. No modification to the docks or associated facilities shall be made without prior approval of the Club Manager.

 

18. Signs (For Sale, Vote for… etc.) placed on Members’ boats, will be limited in size to approximately 24 x 18 inches.  Members’ signs, except those simply advising caution, identifying the boat or owner, etc. will not be placed on docks or related structures.

 

19. Grills are permitted on the docks only after approval by the CYC Board of Directors and the Coronado Fire Department Fire Marshal, subject to the following regulations:

 

a.             Only propane-gas-fueled grills are to be used.

 

b.             An area or areas will be designated on each dock where grills may be placed and tied to eye bolts provided.  All boat owners within 50 feet of the proposed site shall be contacted for approval.

 

c.             Grills are not to be moved from designated areas.  Only grills in designated areas are allowed on the dock.

                d.             Owner(s) must maintain grills as follows:
                                1.  in safe operating condition
                                2.  in a rust-free, clean & attractive condition
                                3.  provide a uniform cover
                                4.  ensure secure tie-downs are maintained

               

e.             All dock slip renters shall be free to use the grill   on

their dock.  Each owner or owners shall develop their own plan for maintenance and gas tank refill.  The Club does not supply propane.

                               

f.             The Board of Directors, the Club Manager, or the Dockmaster may request repairs to be made to maintain required standards.  If standards are not maintained, Club Management has the right to remove the grill to the maintenance area until repairs are made.

 

20.  When available, temporary slip assignments at CYC, including

those for CYC regatta participants, may be made by the Port Captain, Assistant Port Captain, General Manager, or the Facilities Director.  No other person may make slip assignments.  Temporary assignments may be made to designated wet or dry slips, or to the gravel parking lot.

 

For temporary assignment in the gravel parking area, CYC Flag and Junior Flag members will be charged the rate of $2.20 per foot, per month based on LOA (including trailer), prorated.  Reciprocals and those holding Guest Cards will be charged the rate of $0.30 per foot, per day LOA (including trailer), for the gravel parking area.  Temporary wet slip assignments will be charged according to the current CYC Slip Regulations.

 

When temporary wet or dry slips are available, participants in CYC regattas may be berthed for two days prior to the regatta and for one day after the regatta at no charge.

 

All vessels requesting temporary berthing at CYC must provide current registration/documentation, current proof of insurance, and emergency contact information prior to being assigned a temporary dry or wet slip at CYC.

 

21.  The Club is responsible for the care and maintenance of telephone

       and television service to the terminals on each dock.  Members are

       responsible for all service wire, cable, jacks and cords that feed

       their boats.

 

22.  STORAGE SHEDS:

 

a.             The Port Captain shall maintain and post a WAITING FOR SHED LIST.  The list will be in chronological order of the date the member requested the shed.  A member must be assigned a wet or a dry slip to be placed on the WAITING FOR SHED LIST.  Only owners assigned wet or dry slips at the CYC may rent storage sheds.  A list of boat owners occupying storage sheds will also be posted.

 

b.             When a shed becomes available, the Port Captain will query the WAITING FOR SHED LIST in chronological order.  If a member declines the offer of a shed, his/her name will be moved to the bottom of the waiting list using the date he/she declined the offer.

 

c.             Members offered a half shed may decline without jeopardizing their placement on the WAITING FOR SHED LIST.

 

d.             Only one storage shed per membership will be allowed.

 

e.             If a member sells or otherwise disposes of his/her boat, he/she may retain his/her shed for the same period that is permitted to retain the unoccupied slip.

 

f.             The monthly charge is $52.50 for a full shed and $26.50 for a half shed. 

 

23.          Storage of Dinghies and Similar Craft

 

                a.             No boat may be left on the docks or walkways.

 

b.             Dinghies may be stowed on dock extensions or racks, but only in the immediate vicinity of the parent boat and only when location and type of installation has been individually approved by the Port Captain.  Dock extensions or racks must be such as to store the dinghy over the water, not on the dock.  Should the owner remove his/her boat from the slip for more than 24 hrs. he/she must also remove the dinghy.

 

c.             Dinghies may be left in the water adjacent to the parent boat, but only if the space utilized is already included in the slip rental.  Dinghies will not be berthed in such a manner as to interfere with any other boat.

 

d.             Temporary Gravel lot trailerable vessel parking

guidelines

 

1.       Upon approval of the Port Captain, Facilities Director or General Manager temporary boat parking can be permitted in the clubs EAST gravel lot for a period between 1 and 7 days.

 

2.       Current registration, insurance and CYC release agreement  must be submitted to the office prior to occupying the gravel space.

 

3.       The Daily rental for members will be a $1.00 per foot per day and $2.00 per foot per day for reciprocal members.

 

4.       Due to the impacted parking on special occasions at the Coronado Yacht Club no temporary parking will be permitted July 1-7th, May 26-31, September 1-7 and other high impact days as determined by the General Manager.

 

5.       Temporary boat parking will be available in 7 day increments; no new 7 day period can be renewed until the end of business of the 6th day of the existing rental period.

 

6.       The priority for being assigned temporary space will be as follows:       

a.       CYC member on existing wet or dry wait list

b.       CYC member

c.        Reciprocal member

 

24.          For the purpose of pumping seawater from boats, the Dockmaster will provide a portable electric pump on request. 

 

25.          No water or electrical cord connected to a boat shall be allowed to be immersed in bay water. 

 

26.          All water connections to a boat shall be turned off when the boat is not occupied. 

 

27.          Normally only Club members who are the owners or charterers of a yacht shall operate the yacht from the Yacht Club property.  Members may permit others to board or remove their boat from the Club property after advising the Club office of their intentions, including the identity of the second party, duration of the use and proof of insurance coverage.  They shall arrange for a guest card if appropriate.

 

28.          Boats of commercial registry or available for commercial use will not be assigned slip space and will not be permitted to use the docking facilities of the Club.

 

29.          Swimming and diving from the docks or walkways is prohibited except for maintenance or for Club sponsored, supervised water safety training.

 

30.          Members are expected to enhance the security of the Club premises, particularly the dock area, by positive awareness of persons or situations that may threaten the safety or security of the Club, persons or property, and to take such action as may be appropriate. The reporting of fires, boats in distress, and observed or suspected thefts is specifically expected.



31.          Policy on Disposal of Hazardous Waste

 

a.             Overboard discharge of marine sanitation devices is prohibited while at CYC. Both improperly installed marine sanitation devices and improper disposal practices (pumping overboard within three miles of the nearest land) are illegal. The U.S. Environmental Agency “No Discharge Zone” includes San Diego Bay, Mission Bay, Oceanside Harbor and Dana Point Harbor. The Federal Clean Water Act, the San Diego Unified Port District Code, and related city and county codes apply.

 

b.             Disposal of hazardous waste anywhere on Club property is strictly prohibited. This includes batteries, oil, filters, expended zincs, etc.

 

c.             Every precaution should be taken to guard against fuel spills, including the use of oil-absorbing materials in the bilge. Should a fuel spill occur in spite of precautions, the use of detergents and emulsifiers is prohibited. All spills, whether fuel, chemical, or other material, shall be cleaned up immediately.

 

d.             Alongside or underway, sound practice requires compliance with the laws and regulations that define legal disposal.


32.          Policy on Fish Cleaning:

 

The Club does not have an on-site station for fish cleaning and the cleaning of fish on Club property is not permitted

33.          Policy on Underwater Hull Cleaning:

 

a.             In order to keep paint intact, on the hull, and prevent contaminates, including copper contained in antifouling hull paint, from entering the water, hull cleaners:

1.       Shall use only carpet, sponge or soft

nylon material to clean the hull.

2.       Shall not use aggressive abrasives such

as sandpaper, stainless steel pads, and/or scrapers on hull paint.

3.    May use stainless steel pads and brushes

        or scrapers on unpainted metal only.

        i.e. shafts, props,  struts, etc.

 

b.                   Expired zincs shall be removed to shore and recycled in a  legal manner.

 

c.                    It is the boat owner’s responsibility to instruct the  diver hired to clean the hull of this policy and insure compliance.

d.             Recognizing the potential environmental effects of toxic materials, only  legal hull paint or nontoxic coverings should be used on boat hulls. Members observe the published sound practices for the application and maintenance of hull paints.

 

34     Effective December 1, 2010, rental rates for berthing in wet slips are as follows:

 

a)       Temporary wet slips for boats or yachts belonging to Associate or Temporary Members of Coronado Yacht Club, members of recognized yacht clubs, and those holding guest cards:

 

Daily Temporary Wet Slip Rental Rate:  $0.75 per ft. (after three consecutive days)

 

b)       Monthly wet slips for boats or yachts belonging to Coronado Yacht Club Flag, Life Flag, Junior Flag, and Junior Members:  

 

Monthly Wet Slip Rental Rate:  $5.10 per foot (includes membership approved annual wet slip rate increases provided in 36. c) below).

 

c)       Commencing 1 December 2003, wet slip rates will increase $0.10 per foot per month annually until the Coronado Yacht Club’s lease is renewed, at which time the rate will be adjusted as required. 

 

d)       Total wet slip rental fees will be calculated and charged on a basis of LOA or slip length, whichever is greater.

 

35.          Flag, Life Flag and Junior Flag members who do not have assigned wet or dry slips for their yachts at the Club and wish to temporarily occupy a slip, may be assigned any available space or facility by the Port Captain, and if so assigned, after three days (per visit) will be charged at the daily rate, not to exceed the monthly rate for the slip. Such visits will be accommodated when space is available and authorized by the Port Captain.  Boats temporarily berthed under this rule must leave the Club when directed by the Port Captain.

 

36.          Effective December 1, 2010, rental rates for berthing in dry slips, including the Sabot and Laser docks, are as follows:

 

a)       Temporary dry slips for boats or yachts belonging to Associate or Temporary Members of Coronado Yacht Club, members of recognized yacht clubs, and those holding guest cards:

 

Daily Temporary Dry Slip Rental Rate:  $0.50 per ft. (after three consecutive days)

 

 

b)       Monthly dry slips for boats or yachts belonging to Coronado Yacht Club Flag, Life Flag, Junior Flag, and Junior Members:

 

Monthly Dry Slip Rental Rate:  $2.85 per foot (includes membership approved annual dry slip rate increases provided in 35 c).

 

c)       Commencing 1 December 2003, dry slip rate will increase $0.05 per foot per month annually until the Coronado Yacht Club’s lease is renewed, at which time the rate will be adjusted as required.

 

d)       Total dry slip rental fees will be calculated and charged on a basis of the length overall of the boat and trailer. 

 

e)       Boats stored in the dry slips will be charged on a per foot basis based on the dry slip rate for the length overall of the boat and trailer.  These rates are as stated above.

37.          Rules for Dry Slips 

a.               The combined length overall of a qualifying vessel and trailer placed in a Dry Slip shall not exceed the length the assigned Dry Slip and shall not be shorter than the slip length minus 5 feet.  No portion of the vessel or trailer shall extend beyond the boundaries of the assigned Dry Slip.  Any exceptions to the rule must have prior written approval from the Port Captain.

b.                A vessel may not be continuously absent from its trailer in the assigned Dry Slip for more than three months.  The trailer vessel must occupy the assigned Dry Slip for at least 50% of each year.

            c.                 Members who are assigned a Dry Slip must sign a CYC Dry Slip Rental Agreement prior to placing a trailer vessel in the assigned Dry Slip.

d.               Trailers must be returned to the assigned Dry Slip or removed from Club premises after the vessel is launched.  Trailers and/or trailer vessels may not be left in aisles or fire lanes at any time.

e.               Each assigned Dry Slip is to be used for the trailer vessel assigned to that Dry Slip only.  Trailer vessels and/or items owned by other members or non-members may not be placed in the assigned Dry Slip.

f.                 Dry Slips will be assigned based upon the size and type of trailer vessel.  The Port Captain may reassign Dry Slips when it is determined by the Board to be in the best interests of the Club.  Dry Slips may not be assigned for vessels that have been assigned to a Wet Slip. 

g.                Dry Slips are provided for Members in good standing for parking a trailer vessel when not in the water.  Dry Slips are to be used for that purpose only.  Trailer vessels include sailboats, power boats, and dinghies.  A trailer vessel is one vessel on a trailer that is properly designed and sized for that vessel.  A properly designed and sized dolly or other mobile handling equipment will be considered to be a trailer for purposes of this rule.

h.                Only the trailer, with or without the vessel, and one approved dock box may be on the ground within the boundaries of the assigned Dry Slip. Up to two other items such as kayaks, paddleboards, and inflatables may be stored in the vessel or on the trailer, not on the ground, with prior written approval of the Port Captain.  Racks are not allowed in Dry Slips.            

 

 

 

38.   Vessel Maintenance.

      

a.               Other than routine ordinary maintenance and minor repairs, no work shall be done on any vessel while in a CYC wet slip or dry slip, without a permit issued by the General Manager or Facilities Director.  Once issued, the permit will be conspicuously displayed on the vessel while maintenance is being performed.

 

b.               Maintenance or repair performed while in a wet or dry slip shall be limited and conducted in accordance with sound environmental practices.  Members and their guests, agents, contractors and employees must comply with all current San Diego Unified Port District maritime and environmental laws and regulations while on the CYC leasehold and shall not engage in any activity that could be construed as being in violation of the Federal Clean Water and Clean Air Acts, or any other federal, state or local environmental statute.

 

c.               No waste or other material, including sanding dust and scrapings, should be allowed to enter the water or be deposited on the leasehold.  Sanding should be done wet or with vacuum removal of dust.  Tarps should be used to capture waste, debris, and drips.

 

d.               Spray painting is prohibited.

 

e.               Limit the amount of open solvents or paints to one gallon at a time.

 

f.               Do not dispose of any paint, oil, varnish, solvent, or other toxic material in CYC trash containers.

 

g.               Use only biodegradable soaps and cleaners.

 

h.               Maintenance or repair work that may cause damage to CYC docks, parking lots or other property is prohibited.

 

i.                The Member to whom a wet or dry slip is assigned shall be financially responsible for all damages caused by any maintenance or repair conducted in the assigned slip.

 

YACHT STANDARDS AND

THE BOAT SURVEY COMMITTEE

 

The purpose of these Standards is to require all yachts kept at the Club to be used regularly and maintained to an appropriate standard, and to require that all necessary documentation be provided.  The Standards apply to all yachts, vessels, boats and dinghies (hereafter referred to as “yachts”), which are assigned to a wet or dry slip on the Club's leasehold.  Yachts not meeting these standards shall lose their privilege to remain at CYC.

 

1.             Standards:

 

a.             Each yacht and associated handling equipment shall be maintained mechanically and aesthetically, in a condition which reflects the Standards of the Coronado Yacht Club; that is, in a condition which the General Membership would recognize to be within a range of quality worthy to fly the Club burgee.

 

b.             Each yacht shall be maintained in a seaworthy, operable condition.  Each yacht shall be cleaned regularly and painted and varnished surfaces shall be maintained in good condition.  If the yacht is powered, the engine must be operable and capable of producing sufficient way to make the yacht maneuverable.  Sailing yachts without engines must be equipped with sails and all standing and running rigging must be seaworthy.  The CYC Board shall be the sole judge of the seaworthiness, condition and maintenance of a yacht and may inspect each yacht periodically to determine whether the yacht is seaworthy and properly maintained.  Yachts and associated handling equipment must be operable at all times. 

 

c.             Each yacht and associated handling equipment, if required by law, shall be legally registered with the DMV and display current DMV registration stickers and CF numbers, or possess current U.S. Coast Guard Documentation papers and be correctly identified according to USCG Regulations.  A copy of the current registration or documentation shall be filed at the Club office before slip assignment and annually thereafter as soon as possible after each expiration date.  See Slip Regulations, Evidence of Ownership. If a true copy of current Documentation or registration is not provided within 30 days of the expiration date, written notice will be sent to the member requiring immediate presentation of an acceptable copy of the Documentation or registration and the member shall be assessed a penalty fee, on a monthly basis from the date of expiration, in an amount equal to the member’s monthly slip fee, until the required copy is provided. If the required copy is not provided within 60 days of the date of the expiration of the Documentation or registration,, the Board of Directors may, after considering the facts and interviewing the member, determine that the member willfully violated Club rules and withdraw the member’s slip privileges and terminate the member’s Slip Agreement.  A member who has had their slip privileges withdrawn shall remove their yacht and surrender the slip within 10 calendar days from the date the privileges are withdrawn.

 

d.             Each yacht shall be maintained in a condition that will comply with minimum U. S. Coast Guard safety requirements and shall be maintained in an insurable condition. Members keeping yachts in slips assigned to them at CYC shall have in effect liability insurance for the protection of CYC and others with a minimum coverage limit of $300,000. The cost of insurance shall be paid for by the member. Each member shall, before locating his or her yacht at the slip and annually thereafter, file with the Club office proof of liability insurance coverage showing CYC as an additional insured. If such proof of liability insurance is not provided within 30 days of the expiration date of a previous policy, written notice will be sent to the member requiring immediate presentation of such proof of liability insurance and the member shall be assessed a penalty fee, on a monthly basis from the date of expiration, in an amount equal to the Member’s monthly slip fee, until the required proof of liability insurance is provided. If the required proof of liability insurance is not provided within 60 days of the date of the expiration of the previous policy, the Board of Directors may, after considering the facts and interviewing the Member, determine that the Member willfully violated Club rules and withdraw the member’s slip privileges and terminate the Member’s Slip Rental Agreement.  A Member who has had their slip privileges withdrawn shall remove their yacht and surrender the slip within 10 calendar days from the date the privileges are withdrawn.   Members shall provide written notice to CYC of any change in insurance carrier, insurance agent or policy number, within 5 days of the occurrence of any such change.  Members will notify CYC immediately if Member’s insurance is cancelled or terminated for any reason or if Member’s coverage limit is reduced below the required level.

 

e.             Each yacht shall always be safely and properly secured to its slip in a manner acceptable CYC. 

 

f.             Each yacht assigned to and kept in a CYC wet slip or dry slip shall be actively engaged in yachting, and be capable of getting underway from its slip and performing the underway-yachting activities appropriate to comparable yachts.  Each Member keeping a yacht in a slip assigned to them at CYC must demonstrate that the yacht is capable of getting underway a minimum of one time each year, with the Member on board, by traveling under its own power to Glorietta Bay buoy # 1 and back to its slip. If the yacht is jointly owned, each joint owner must make the required trip a minimum of one time. The one trip must be verified by one of the following:  Port Captain, General Manager, Director of Facilities, or a member of either the Boat Survey Committee or the Board of Directors.  If a Member or joint owner does not complete the required one trip annually prior to December 31st, the Member and/or joint owner shall be notified by letter of failure to meet the minimum underway requirement.  If the Member and/or joint owner has not satisfactorily met the previous year’s underway requirement within 30 days of the date of the notice of failure to meet the underway requirement, the Member and/or joint owner shall be assessed a penalty, on a monthly basis from January 1st, in an amount equal to the Member’s monthly slip fee, until the previous year’s underway requirement is met.  If the previous year’s underway requirement is not met within 60 days of January 1, the Board of Directors may, after considering the facts and interviewing the Member, determine that the Member willfully violated Club rules and withdraw the Member’s slip privileges and terminate the Member’s Slip Rental Agreement.  A Member who has had their slip privileges withdrawn shall remove their yacht and surrender the slip within 10 calendar days from the date the privileges are withdrawn.

 

g.             Upon notification by the Boat Survey Committee that a yacht assigned to and kept in a CYC wet or dry slip does not appear to be safe and/or seaworthy the Board of Directors may require the Member to have the yacht inspected by the United States Coast Guard Auxiliary and to pass the inspection.  The Board of Directors may require that a yacht be removed from the CYC leasehold if, at its discretion, the Board determines the yacht represents a potential serious hazard to neighboring yachts and/or club property.    

 

2.             The Boat Survey Committee will monitor compliance with the above standards and report its findings to the CYC Board.

 

 

 

 

SLIP ASSIGNMENT GUIDELINES

CORONADO YACHT CLUB

 

       1.       The following guidelines may only be changed by a majority vote of the General Membership present and voting at either the Annual or Semi-Annual Coronado Yacht Club meetings. 

 

       2.       Slip use policy, as determined by the Board of Directors acting through the Port Captain as its agent, shall be to effect the maximum utilization of slip space, enhance the security of the docks, and encourage active participation in boating activities.

                

       3.         REQUEST FOR A SLIP ASSIGNMENT:

                

a.       Any member not in Senior Flag or Absent Status may submit

a request for a slip, different slip, or larger size slip, as appropriate.  Such request must be in writing on the form provided for that purpose.  It will:

                   (1) Specify the type of boat (power or sail).

                            (2) Specify LOA, Beam and Draft.

           (3) Be delivered to the Club office during normal office hours.

                            (4) Incomplete forms cannot be accepted.

 

        b.      Staff personnel will enter date and time of receipt and forward request to the Port Captain who will:

                           (1)   Acknowledge receipt by endorsement,

                           (2)   Assign the Member a slip, if available, or:

             (3)    Enter the request on the appropriate list, chronologically

                      by slip length, according to the time and date of receipt

                      annotated by the office staff.

                           (4) Return the original to the office for member's file.

       4.       Each member is allowed one wet slip and one dry slip, if available.  The assigned wet slip and dry slip may not be used for the same boat.  If a member is assigned a dry slip and later assigned a wet slip for the same boat, the dry slip must be relinquished.  If a Member is assigned wet slip and later assigned a dry slip for the same boat, the wet slip must be relinquished.

 

       5.       Determination of required slip size will be confirmed by the Port Captain by measuring the dimensions of the boat.  The dimensions of the boat will be determined by:

 

a.       LOA which is the overall length of the boat including

bowsprit, bow anchor, boomkin, swim step, dinghy or davits,  self steering gear, or any other normal appurtenance in its normally installed position.

b.       The overall beam of the boat, to ensure that adequate beam

          spacing is maintained in slips.

                    c.    The draft of the boat.

 

       6.       SLIP ASSIGNMENT:

 

        a.      Upon assignment to a slip, a member is required to sign a Slip Rental Agreement.  Upon occupancy of the slip, the member is required to establish proof of ownership or charter agreement of the boat as outlined in the "Evidence of Ownership" section.

 

b.       The Port Captain will use the following formula as a guide in making slip assignments.  This formula, being only a guide, may be departed from by the Port Captain as necessary to fit special conditions.

 

                 Slip Length:    +7% rounded to the nearest foot.

                                                      - 6% rounded to the next foot.

                 The following table is a sampling of the application of this formula:

                 A boat assigned to a slip according to the above guidelines is considered a CONFORMING BOAT and the slip a CONFORMING SLIP.

 

c.             Time Allowed to Fill a Slip After acceptance of a slip assignment, a temporary Slip Rental Agreement will be issued until the Member’s conforming vessel occupies the slip.  If a slip is not occupied by the Member's conforming vessel for a period of three months after acceptance of a slip assignment, the Slip Rental Agreement may be terminated. The Board of Directors may, in special circumstances, extend this time period (e.g. cruising, offshore delivery or other delivery difficulties, extensive yard repair.) The request for extension must be in writing and submitted to the Board of Directors before the time expires.

 

d.             Cruising Status -“Cruising” is defined as: Extended voyaging on one’s boat further than 500 miles from Coronado Yacht Club and/or outside of the waters of the United States.   A Member assigned a wet slip who wishes to go cruising and vacate that slip for a minimum of six months may apply for "cruising status".  A member in cruising status can be reviewed by the Board annually to insure he/she still meets the definition of "cruising".   There is no restriction on the length of time beyond the six months that the vessel may be away from CYC as long as it is “cruising” as defined above. During the slip assignee's absence, wet slip fees will be reduced by 75%. A returning Flag Member on cruising status will be returned to the formerly assigned slip.  A thirty day notice of departure and return is required. (Temporary occupation of the vacated slip in accordance with paragraphs 6. and 34. of SLIP RULES and REGULATIONS)

               

                         e.     If a Member sells or otherwise disposes of his/her boat, the boat must be removed from the slip within 30 days of change of ownership.  If the Member intends to replace the boat, he/she may retain and leave the slip vacant for a period of up to three months starting the day of change of ownership of the boat vacating the slip in accordance with paragraph 6.c.

 

a.       In assigning slips the Port Captain will take security considerations into account.

 

7. SLIP WAIT LIST: When wet slips are not available to fill all requests, the Port Captain will maintain SLIP WAIT LISTS, Ready and Not Ready, which will be displayed in the Clubhouse and posted on the CYC Website.  These lists are available to all members (except Senior Flag and Absent Members) who are waiting for an initial slip assignment or who are assigned a slip but desire a larger slip.

 

Members may choose to be placed on the Ready Wait List or the Not Ready Wait List:

Members may choose to be placed on the Not Ready Wait List: placement on the Not Ready Wait List does not require a fee or a declared slip size category selection.  The Not Ready Wait List is priority ordered by the Member’s current wait list sign-up date.

 

Members choosing the Ready Wait List will be sequenced by their current wait list sign-up date within each slip size category.  When a slip becomes available for assignment it will be offered to the Member with the oldest wait list sign-up date in that slip size category starting with position one.  A fee of $500 is required to sign up on the READY Slip wait list. Upon assignment to a slip, this $500 fee is applied to monthly slip rental fees.

 

If a slip is assigned and the member fails to comply with Slip Rules 6. Slip Assignment, a, b, or c, the member forfeits the $500 fee, is removed from the Slip Wait List and loses their slip list sign up date. The forfeited $500 fee will be transferred into the Slip Replacement Fund.

 

Movement between lists:

A Member may move from the Not Ready Wait List to the Ready Wait List by paying a $500.00 fee and declaring a slip size category.  The $500.00 fee will be applied to the Member’s slip rental fees upon assignment and acceptance of a wet slip. 

 

Upon request, transfers may take place from the Ready Wait List to the Not Ready Wait Lists.  However, to transfer from the Ready Wait List to the Not Ready Wait List the Member loses the $500.00 fee previously paid to be on the Ready Wait List and the Member is then “frozen” on the Not Ready Wait List for one calendar year, however, the Member retains their current wait list sign-up date.  To transfer back from the Not Ready Wait List to the Ready Wait List after the one calendar year “freeze”, the Member pays another $500.00 but they can choose the same or declare a new slip size category.  The Member will then be placed in their declared slip size category by the Member’s current wait list sign-up date.  In any event, the transferring Member may never be placed higher than position number 3 in any slip size category.  The existing top 2 positions in each slip size category are considered “safe”; even though a new transferee has an earlier original wait list sign-up date in that slip size category.

Changing slip sizes from the Ready Wait List:

To change slip size categories from the Ready Wait List, a Member must first move from the Ready Wait List to the Not Ready Wait List.  They will forfeit their $500.00 fee.  They will be “frozen” on the Not Ready Wait List for one calendar year.  After which time, the Member can then move back to the Ready Wait List upon payment of a new $500.00 fee and they can then declare their new slip size category desired. All assignments will be made in writing and include date established.  When accepting a wet slip, guideline 6.c. applies.

 

       8.       BETTER SLIP LIST

 

                 The BETTER SLIP LIST will include all members who request:

                   a.   A slip of the same size in a different location.

b.  A slip as an Extended Cruising Status returnee.

 

                 The list will be sequenced by date of the request within slip size.  Members requesting slips of the same size in a different location may decline any offer without penalty.   Extended Cruising Status returnees must accept an appropriate size slip when offered, or their request shall revert to the Slip Wait List, using the date his/her boat returned to the yacht club from extended cruising.  All assignments will be made in writing and include date established.

 

       9.       PRIORITY OF ASSIGNMENT OF SLIPS

 

Vacant slips will first be offered to Members on the BETTER SLIP LIST by date within slip size category.  Slips remaining will then be offered to Members on the SLIP WAIT LIST by date within slip size category.

 

       10.     PURCHASE OF SMALLER YACHT

 

                 If a Member has occupied a slip with a conforming boat for a minimum period of one year, they may replace the boat with a smaller, non-conforming boat and must notify the Port Captain immediately.  They may occupy their present slip until a permanent, non-temporary conforming slip becomes available. The Member will be added to the Better Slip List for the conforming size slip that is required, using the date his/her boat was designated as a smaller yacht. A “conforming slip” and “conforming boat” are defined in Section 6. Paragraph b. of the Slip Assignment Guidelines.  They will then be moved to the new location at the direction of the Port Captain

                

       11.  VOLUNTARY SLIP RELINQUISHMENT

 

If a Member, having held a slip for a minimum of three years, voluntarily relinquishes his/her slip assignment, the member will be placed on the bottom of the Better Slip Waiting List by date of relinquishment. The following conditions would apply:

 

a.       The Member must exercise the option to be assigned a new slip from the Better Slip List within three years, and failure to do so will cause the member to be placed at the bottom of the regular Slip Waiting List.

 

b.       The new slip assignment must be for the same sized slip.

 

c.        The Member must accept the first same sized slip offered, and failure to do so will result in being placed at the bottom of the regular Slip Waiting List.

 

d.       In order to exercise his/her option, the member must not have entered into any new partnerships before being assigned a new slip under these guidelines.
